Welcome to MOHITI.
These Terms & Conditions apply to your use of the MOHITI website and to purchases made directly from us. By using our website or placing an order, you agree to these terms.
Nothing in these Terms & Conditions limits or excludes any rights you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other rights that cannot legally be excluded.

2. Products
We make every reasonable effort to ensure that product descriptions, photographs, colours, measurements, lens strengths and other information on our website are accurate.
However, colours and appearance may vary slightly depending on your screen, device or lighting.
Please carefully check the product description and, in the case of reading glasses, the lens strength selected before completing your order.
Nothing in this section limits your rights where a product is faulty, materially different from its description or otherwise does not meet the guarantees required by New Zealand law.
3. Reading Glasses
MOHITI reading glasses are ready-made reading glasses intended for general near-vision assistance.
Customers are responsible for selecting the lens strength that is appropriate for them unless they have relied on specific advice provided by MOHITI.
Our products are not intended to replace professional eye examinations, diagnosis or treatment.
If you experience significant vision changes, eye discomfort or are unsure which strength is suitable, we recommend consulting a qualified optometrist or other appropriate eye-care professional.
4. Prices
Unless otherwise stated, prices displayed on our New Zealand website are in New Zealand dollars (NZD).
Any applicable GST will be included or clearly shown as required.
Delivery charges and any other applicable costs will be displayed before you complete your purchase.
We make reasonable efforts to ensure prices are accurate.
If we identify a genuine pricing or website error before an order has been dispatched, we will contact you and give you the option to proceed at the correct price or cancel the affected item for a full refund.
We will not rely on a pricing-error provision in a manner that would breach applicable New Zealand consumer law.
5. Orders
Submitting an order does not necessarily mean that we have accepted it.
After receiving your order, we may send an order confirmation or acknowledgement.
We may decline or cancel an order before dispatch where reasonably necessary, including where:

There is an obvious pricing or website error.

Payment cannot be processed or verified.

We reasonably suspect fraudulent or unauthorised activity.

An incorrect shipping option or address prevents us from fulfilling the order.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product and any corresponding charges that should be refunded.
Nothing in this section affects your rights under applicable consumer law.
6. Payment
Payment must be completed using one of the payment methods available at checkout.
By placing an order, you confirm that you are authorised to use the payment method provided.
We do not impose deductions from refunds required by law simply because a particular payment method was used.
7. Promotions and Discounts
From time to time, MOHITI may offer discounts, promotional prices, multi-buy offers, member offers or promotional codes.
Unless otherwise stated:

Promotions cannot be exchanged for cash.

Promotions apply only during the advertised promotional period.

Offers are subject to any clearly disclosed eligibility requirements.

Discounts may not be combined unless expressly stated.

Promotions are subject to product availability.
Any material conditions applying to a promotion will be disclosed clearly.
MOHITI may correct genuine technical errors affecting a promotion, but we will not use these terms to mislead customers about pricing, discounts or availability.
8. Membership Offers
Where MOHITI provides ongoing benefits to registered customers or members, the applicable eligibility requirements and pricing will be shown on our website or at checkout.
Membership or customer account benefits may be amended from time to time, but changes will not retrospectively remove rights from orders that have already been accepted.
9. Shipping and Delivery
Shipping charges, delivery areas and estimated delivery times are set out in our separate Shipping Policy.
Delivery estimates are estimates unless we expressly agree to a specific delivery date.
Where MOHITI arranges delivery, we remain responsible for ensuring the order is delivered within the agreed timeframe, or within a reasonable timeframe where no specific timeframe has been agreed, as required by applicable New Zealand consumer law.
Please contact us promptly if your order is delayed, lost or arrives damaged.
10. Delivery Address
Customers are responsible for providing a complete and accurate delivery address.
Please contact us as soon as possible if you notice an address error.
We cannot guarantee that an address can be changed once an order has been dispatched.
If an order is returned to us because an incorrect or incomplete address was supplied by the customer, we may charge reasonable additional delivery costs for resending the order where permitted by law.
11. Returns, Exchanges and Faulty Products
Returns, exchanges and refunds are governed by our Returns & Exchanges Policy.
Our voluntary returns policy is in addition to, and does not replace, your rights under the New Zealand Consumer Guarantees Act 1993.
If an item is faulty, damaged, incorrectly supplied, materially different from its description or otherwise fails to meet applicable consumer guarantees, you may be entitled to a remedy under New Zealand law.
12. Change of Mind
New Zealand consumer law does not generally require a retailer to provide a refund simply because a customer changes their mind.
However, MOHITI may accept eligible change-of-mind returns in accordance with our Returns & Exchanges Policy.
13. Website Availability
We aim to keep our website accurate and available, but we cannot guarantee uninterrupted or error-free access at all times.
The website may occasionally be unavailable because of maintenance, updates, technical issues or circumstances outside our reasonable control.
We may update website content and functionality from time to time.
14. Intellectual Property
Unless otherwise stated, all MOHITI trademarks, logos, branding, photographs, graphics, website content, product designs and written material belong to MOHITI or are used with permission.
You may use the website for your personal, non-commercial use.
You must not copy, reproduce, modify, distribute or commercially use our intellectual property without prior written permission, except where permitted by law.
15. Third-Party Services
Our website may use or link to services provided by third parties, including payment providers, delivery providers or other websites.
Those third parties may have their own terms and privacy policies.
MOHITI is not responsible for independent third-party websites that are outside our control, but this does not limit any responsibility we have under New Zealand law for services we arrange as part of your purchase.

To the maximum extent permitted by law, MOHITI will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
However, nothing in these Terms & Conditions excludes, restricts or modifies any liability or consumer right that cannot legally be excluded, restricted or modified.
In particular, these Terms & Conditions do not limit your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where those laws apply.
17. Personal Information
We handle personal information in accordance with our Privacy Policy and applicable New Zealand privacy law.
Information provided when placing an order may be used to process payments, fulfil orders, provide customer support and communicate with you about your purchase.
Marketing communications will be handled in accordance with applicable law and any choices you make.
18. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version applying to your purchase will generally be the version published when your order was placed.
Changes will not remove statutory rights relating to an existing purchase.
19. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Any dispute will be dealt with in accordance with applicable New Zealand law and the jurisdiction of the New Zealand courts and tribunals.
